Terms of Service

These Terms of Service (“Terms”) govern your use of Nightcap Bingo (“the Service”), an interactive bingo game that venues run for their patrons. By creating an owner account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.

Who can use it

The Service is for venues (bars, restaurants, and similar) and their adult patrons. Owner accounts are for the business that operates the venue. You must be able to enter into a binding contract to create an account, and you're responsible for keeping your login credentials secure.

The plan & billing

Music & performance licensing

Nightcap Bingo does not play recorded music and does not grant you any music rights. The Service only displays factual information (such as titles or answers). If you choose to play music in your venue during a game, obtaining and paying for any required public-performance licenses (for example from a performing-rights organization) is your responsibility, not ours.

Acceptable use

Prizes & promotions

Any prizes, giveaways, or specials offered through a game are set and provided by the venue, not by us. The venue is solely responsible for honoring them and for ensuring any promotion complies with local law.

Your content & data

You keep ownership of the content you provide (venue name, logo, custom text). You grant us a limited license to host and display it so the Service can function. Our handling of personal information is described in our Privacy Policy.

Availability

We work to keep the Service running but don't guarantee it will be uninterrupted or error-free. We may update, suspend, or discontinue features. Planned downtime and outages can happen; run a critical event with that in mind.

Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, to the fullest extent permitted by law.

Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for lost profits or revenue. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the twelve months before the claim.

Termination

You can stop using the Service and close your account at any time. We may suspend or terminate accounts that violate these Terms. On termination, your right to use the Service ends; provisions that by their nature should survive (such as billing owed, disclaimers, and liability limits) will survive.

Changes to these Terms

We may update these Terms; we'll change the “Last updated” date above and, for material changes, provide reasonable notice. Continued use after changes means you accept them.
